§ 26-70. Certain vehicles must yield at all railroad grade crossings.

  • Every railroad track motorcar, handcar or other vehicle operating upon railroad tracks within the city limits, which such railroad track motorcar, handcar or other vehicle operating on railroad tracks is so constructed that it does not activate automatic safety gates or automatic crossing signal devices, shall yield the right-of-way to vehicular or pedestrian traffic traveling on or along any public street intersecting at every railroad crossing within the city. If such driver of every railroad track motorcar, handcar or other vehicle operating upon the railroad tracks is involved in a collision with a pedestrian at a crosswalk or a vehicle in the intersection, such collision shall be deemed prima facie evidence of his failure to yield the right-of-way.
