§ 9-1. Florida Building Code adopted; enforcement.
(a)
The Florida Building Code, 1976 edition, as currently revised, and as it may be subsequently reedited, revised and amended from time to time, is adopted by the city and constitutes the primary building code effective within the city.
(b)
The building official is hereby authorized to enforce this section.
(c)
Any person convicted of violating this section, regardless of whether adjudication is withheld, shall be punished in accordance with the penalty clause of the Florida Building Code, Section 205, and can be placed on probation in accordance with Chapter 948 of the Florida Statutes. The trial court in its discretion may in any case also assess court costs and impose any other lawful condition, term, or order upon a defendant.
(d)
Any violation of the Florida Building Code shall be a violation of this section and punishable as provided for in this section.

" Section 1. Section 104 of the Florida Building Code as enacted by chapter 71-575, Laws of Florida, Special Acts of 1971 is hereby amended to add thereto section 104.9 to read as follows:
Section 104.9. The provisions of this code, including chapter 16, shall not apply to existing buildings and structures within the City of Fort Lauderdale which are of historical significance, or are within a historical area, as determined or designated by ordinance duly passed by said city in accordance with law. Buildings so designated or located may be restored or rehabilitated in accordance with plans approved by the building and zoning department of said city, provided that the health, safety, and welfare of the public shall not be endangered thereby."
