§ 8-176. Action by the marine advisory board and city commission.

The marine advisory board shall initially review the waiver application and submit its recommendation to the city commission. The city commission, at a public hearing, may grant or deny an application. Among other factors, the city commission may consider whether:

(1)

The waiver application is incomplete in a material respect.

(2)

The waiver application has been fraudulently completed.

(3)

The activity proposed under the waiver application could not be conducted without a reasonably likely threat of endangering public safety.
