§ 8-169. Operation of a vessel in violation of state statute.

  • (a)

    The operation of a vessel in violation of state statutes is hereby prohibited. The following state statutes are included in this prohibition:

    (1)

    Section 327.10, Florida Statutes, relating to operation of unregistered and unnumbered vessels.

    (2)

    Section 327.11(4), Florida Statutes relating to display of number and possession of registration certificate.

    (3)

    Section 327.11(5), Florida Statutes, relating to display of decal.

    (4)

    Section 327.13(2), Florida Statutes, relating to display of number.

    (5)

    Section 327.14, Florida Statutes, relating to spacing of digits and letters of identification number.

    (6)

    Section 327.17, Florida Statutes, relating to military personnel and registration of vessels.

    (7)

    Section 327.25(14), Florida Statutes, relating to operation with an expired registration.

    (8)

    Section 327.33(2), Florida Statutes, relating to careless operation.

    (9)

    Section 327.37, Florida Statutes, relating to water skiing, aquaplaning, and similar activities.

    (10)

    Section 327.44, Florida Statutes, relating to interference with navigation.

    (11)

    Violations relating to restricted areas and speed limits: established by the state pursuant to Section 327.46 and Section 370.12(2), Florida Statutes and established by Section 8-166 of this Code.

    (12)

    Section 327.48, Florida Statutes, relating to regattas and races.

    (13)

    Section 327.50(1) and (2), Florida Statutes, relating to required safety equipment, lights, and shapes.

    (14)

    Section 327.65, Florida Statutes, relating to muffling devices.

    (15)

    Section 327.33(3)(b), Florida Statutes, relating to navigation rules.

    (16)

    Section 327.39(1), (2), (3), and (5), Florida Statutes, relating to personal watercraft.

    (17)

    Section 327.53(1), (2), and (3), Florida Statutes, relating to marine sanitation.

    (18)

    Section 327.53(4), (5), and (7), Florida Statutes, relating to marine sanitation.

    (19)

    Section 327.395, Florida Statutes, relating to boater safety education.

    (20)

    Section 327.52(3), Florida Statutes, relating to operation of overloaded or overpowered vessels.

    (b)

    The penalty for violation of this section is fifty dollars ($50.00), except that for a violation of this section relating to Section 327.53(4), (5), and (7), Florida Statutes, the penalty is two hundred fifty dollars ($250.00). The registered owner of the vessel operated in violation of this section shall be deemed the responsible party for purposes of enforcement, whether or not such owner was operating the vessel at the time cited in the citation; provided, however, that a citation issued to the owner of a rental vessel shall ultimately be the responsibility of the lessee of such vessel if the owner furnishes the name and address of such lessee to the city upon request.

    (c)

    Any law enforcement officer may cite the registered owner of a vessel operated in violation of this section by mailing the citation to the address of such owner.
