§ 8-118. Fueling at municipal docks; limitations.

  • (a)

    Fueling of vessels at any municipal dock location is prohibited, except as provided in this section.

    (b)

    The following location is hereby designated as the municipal dock fueling site:

    Municipal dock numbers 541/543, located at South New River Drive immediately west of the New River Tunnel.

    (c)

    The city manger or his designee shall establish regulations for the proper and safe utilization of the fueling site, which regulations shall include but not be limited to the hours of operation and the designation of the fueling site with signage.

    (d)

    The owner or operator of a vessel who desires to fuel his vessel at the fueling site, shall first obtain a permit and a copy of the fueling site regulations from the office of the supervisor of marine facilities. Such permit shall require:

    (1)

    Payment of a fee equivalent to one (1) day of rent for dock space based on the size of the vessel; provided, however, that the fee shall be waived for a vessel already under permit or lease at a municipal dock space.

    (2)

    Execution of a permit and dockage rental agreement.

    (e)

    The supervisor of marine facilities shall deny a permit to the owner or operator of a vessel that he determines, in his sole discretion, may pose a hazard to the safety of persons, property or the environment if fueled at the fueling site.

    (f)

    Businesses desiring to fuel vessels at the fueling site from a tanker truck shall be duly registered and licensed by the State of Florida for such activity. For each such business, all its fueling activity by tanker truck at the fueling site shall be reported to the supervisor of marine facilities in a quarterly report verified by an officer of the firm or an auditor. In addition to any other penalty provided in this Code, a person or firm found to be in violation of this article shall be subject to being suspended or permanently barred from fueling vessels at the fueling site, upon the petition of the supervisor of marine facilities to the city commission, whose action shall be deemed final.
