§ 6-4. Pets, domesticated animals on public property.
(a)
It shall be unlawful, unless otherwise provided, for any person to take any pet or domesticated animal upon:
(1)
The sandy portion of the public beaches in the city;
(2)
Any sidewalk or public property lying adjacent to or part of the public beach and lying east of the centerline of State Road A-1-A (Fort Lauderdale Beach Boulevard and Seabreeze Boulevard) from NE 18 Street south to the northernmost intersection of Seabreeze Boulevard and Harbor Drive;
(3)
Any sidewalk or public property lying immediately west of the centerline of and abutting the State Road A-1-A (Fort Lauderdale Beach Boulevard) right-of-way from Sunrise Boulevard south to the southernmost intersection of Fort Lauderdale Beach Boulevard and Seabreeze Boulevard.
(4)
The Fort Lauderdale Executive Airport property; or
(5)
Any public park or playground area within the city.
(b)
Exceptions to the above include:
(1)
Dog or other domesticated animal shows conducted or sponsored by organizations specifically for that purpose may be permitted upon such public property after obtaining the written approval of the city manager.
(2)
During the hours provided in section 4.1(c)(5) of the department of parks and recreation rules and regulations and in accordance with section 8-76 of the Code, the area of the public beach as described in section 8-76(a) of the Code.
(3)
During the hours provided in section 4.1(c)(5) of the Department of Parks and Recreation Rules and Regulations and in accordance with section 8-76 of the Code, public property abutting the area of the public beach designated for dogs or other pets.
(4)
Use of guide dogs or service dogs pursuant to Section 413.08, Florida Statutes.
(5)
Law enforcement animals while on duty.
(6)
Dogs on a leash only between the hours of 6:00 a.m. and 9:00 a.m. daily, provided that the person walking the dog is in possession of and prominently displaying a valid permit issued by the city. This exception, and the permit issued hereunder, shall only authorize dog walking on the sidewalks or public property on the west side of those portions of State Road A-1-A (Fort Lauderdale Beach Boulevard and Seabreeze Boulevard) south of Sunrise Boulevard to the northernmost intersection of Seabreeze Boulevard and Harbor Drive. Persons walking dogs at a permitted location or time shall have in their possession a device to promptly remove and dispose of their dog's waste. Persons who have been issued a permit pursuant to section 8-76 of the Code of Ordinances of the City of Fort Lauderdale (Canine Beach)prior to October 3, 2000, shall be permitted to take advantage of the three-hour dog walking period with the same limitations as to time and location, without the necessity of obtaining an additional permit from the city, until such time as the permit issued pursuant to section 8-76 expires. Thereafter, a separate permit under this subsection must be obtained.
(c)
It shall further be unlawful for a person to allow or permit a dog or other pet or domesticated animal within that person's control to deposit animal waste (except for law enforcement animals while on duty) upon any public or private property and to fail to promptly remove the animal's waste from the property.
