§ 5-35. Pleasure or excursion boats.

  • Owners of pleasure or excursion boats, who are licensed under the state beverage law to sell alcoholic beverages for consumption on the premises, or their agents or employees, may sell beers, wines and liquors thereon, provided that such boats have the minimum restaurant facilities, accommodations, and seating capacity required for a restaurant bar. Such boats, however, shall be prohibited from cruising or operating in any inland waterways of the city but shall be permitted to cruise or operate in the Intracoastal Waterway subject to regulations of any other governmental body having jurisdiction over such waterway. The sale or dispensing of alcoholic beverages or the serving of food on such boats, shall be permitted only while said boats are underway. The sale or dispensing of alcoholic beverages shall also be permitted while such boats are moored or docked, provided that such sale or dispensing while moored or docked shall be permitted only on one (1) excursion cruise per day, to patrons on board the boat and within thirty (30) minutes of the scheduled departure time, but in no event will such sale or dispensing be permitted prior to 6:00 p.m.
