Chapter 28. WATER, WASTEWATER AND STORMWATER |
Article I. IN GENERAL |
§ 28-1C. Enforcement of emergency and conservation restrictions of water usage and penalties.
(a)
The city shall be responsible for enforcing section 28-1 in accordance with Chapter 11 of the Code.
(b)
Emergency water use restrictions. If conditions of supply or quality so limit the water supply of the water system that unrestricted water use may endanger the adequacy of that supply or quality, the city may adopt emergency water use restrictions. Emergency water use restrictions shall remain in force and effect until the city determines that the conditions requiring their imposition no longer exist. The city may also adopt such regulations and restrictions as are reasonably calculated under all conditions to conserve and protect its supply and to insure a regular flow of water through its system.
(c)
It is the intent of the city to provide, through section 28-1B of this Code, an additional or supplemental means of obtaining compliance with the South Florida Water Management District water usage restriction requirements. Nothing in section 28-1B of this Code shall prohibit the city from enforcing South Florida Water Management District water usage restrictions by any other means available to it.

Editor's note
Section 1 of Ord. No. C-90-28, adopted May 1, 1990, deleted in its entirety § 28-1 and provided for a new § 28-1. Formerly, § 28-1 pertained to emergency restriction of water usage and derived from the 1953 Code, § 45-32. Subsequently, Ord. No. C-09-13, § 1, adopted June 16, 2009 , renumbered former § 28-1 as new §§ 28-1, 28-1A—28-1C and amended same to read as herein set out. Former § 28-1 derived from Ord. No. C-90-28, § 1, 5-1-90; Ord. No. C-06-30, § 1, 9-19-06 . See also the Code Comparative Table for a detailed analysis of inclusion.
