§ 25-191. Intent and purpose.

  • The city commission of the City of Fort Lauderdale finds and declares that the following regulations are necessary to:

    (1)

    Enhance public safety on public property.

    (2)

    Provide for pedestrian and vehicular traffic safety and convenience.

    (3)

    Restrict unreasonable interference with the flow of pedestrian or vehicular traffic including ingress and egress to and from any residence or place of business, or from the street to the sidewalk by persons exiting or entering parked or standing vehicles.

    (4)

    Provide reasonable access for the use and maintenance of poles, posts, traffic signs or signals, hydrants, mailboxes and access to locations used for public transportation purposes.

    (5)

    Provide for public and property safety during hurricane and/or other inclement weather conditions.

    (6)

    Enhance accessibility routes and/or sidewalks on publicly accessed areas.

    (7)

    Maintain aesthetically pleasing and uniform streetscapes throughout the City.

    (8)

    Relocate and/or replace newsracks which result in a visual blight and/or excessive space allocation, on the public rights-of-way or publicly accessed areas, or which unreasonably detract from the aesthetics of store window displays, adjacent landscaping and other improvements, as well as to have abandoned newsrack removed.

    (9)

    Maintain and protect the values of surrounding properties and prevent damage to right-of-way.

    (10)

    Reduce unnecessary exposure of the public to personal injury or property damage.

    (11)

    Establish inventory of types and location of newsracks to facilitate emergency response management.

    (12)

    Establish effective enforcement and administrative measures for implementation.

    (13)

    Treat all publishers equally regardless of their size, content, circulation, or frequency of publication.

    (14)

    Maintain and preserve first amendment rights.

    (15)

    Cooperate to the maximum extent with publishing entities.
