§ 25-183. Permit requirements and fee.

  • (a)

    A permit for a sidewalk café shall be issued only to the owner of a validly licensed and operating place of business, as defined in section 47-35.1 of the ULDR, who wishes to provide tables and chairs on the sidewalk adjacent to their place of business or along the North Fork of the New River as provided in section 25-187.

    (b)

    The application fee and annual permit fee for establishing or maintaining a sidewalk café shall be determined by the city commission and set forth in a resolution. Such fees are to be paid to the director of the department of sustainable development or his or her designee prior to the issuance of a sidewalk café permit. Sidewalk café permits are only valid when the fees, as provided in this section, are paid and current for the period of operation.
