§ 16-54. Placing of foreign objects in edibles.
(a)
Offense. It is unlawful for any person to place any foreign object or substance in any edible with the intent to cause bodily harm to another person. It is further unlawful for any person to knowingly offer, give, sell or otherwise distribute such an adulterated edible to another with the intent to cause bodily harm to another person.
(b)
Definitions. For the purpose of this section, the following terms shall have the meaning given herein:
(1)
Edibles shall mean any candy, fruit, snacks, sandwiches, ice cream, gum, or any other food or foodstuff which one could ordinarily expect another person, regardless of age, to chew, eat, swallow or otherwise consume through the mouth.
(2)
Foreign object shall mean any drug, narcotic, object or any other substance which is placed in an edible and, when subsequently consumed, would be likely to cause harmful effects.
(c)
Penalties. Any person convicted of violating this section shall be deemed guilty of the offense of placing or distributing foreign objects in edibles and upon conviction shall be punished as provided in section 1-6 of this Code.
