§ 16-1.02. Surcharge for certain traffic-related infractions and violations.

  • (a)

    In addition to any other fine, penalty or cost imposed by any other provision of law, a fifteen dollar ($15.00) surcharge is hereby imposed for all civil traffic infractions referenced in F.S. § 318.14, as amended from time to time, and for all criminal traffic violations referenced in F.S. § 318.17, as amended from time to time.

    (b)

    The court shall not waive this surcharge.

    (c)

    Collection, purpose and prohibition of use of surcharge.

    (1)

    The clerk of the court shall collect the fifteen dollar ($15.00) surcharge established in this section and shall remit it to the City of Fort Lauderdale as required under F.S. § 318.21, or as otherwise required by law.

    (2)

    The revenue from the surcharge shall be transferred to the City of Fort Lauderdale for the purpose of replacing fine revenue deposited into the clerk's fine and forfeiture fund under F.S. § 142.01.

    (3)

    Proceeds from the imposition of the surcharge authorized shall not be used for the purpose of securing payment of the principal and interest on bonds.
