§ 13-56. Restriction of smoking tobacco.

  • It shall be unlawful for any person to smoke a cigar, pipe or cigarette or to smoke or burn tobacco in any form in any theatre or motion picture house or any place in the city where signs containing the words "No Smoking" have been posted pursuant to an order of the chief of the fire-rescue department or his representatives. The chief of the fire-rescue department or his representatives shall order such signs erected in any place of public assemblage in the city wherein, in his opinion, smoking would constitute a menace to life or property; provided, however, that this section shall not be construed so as to make it unlawful for a performer to smoke on the stage during and as part of any theatrical production or for any person to smoke in smoking areas designated as such which have been approved by the chief of the fire-rescue department or his representatives.
